INVITATION TO BID
NOTICE TO BIDDERS hereby is given that Bids are invited and will be received as set forth below.
1. OWNER: Bayonne Local Redevelopment Authority
2. WORK TITLE: Proposed Bridge and Bulkhead Construction - Berths S1, E1, and E2 (EDA #01-49-08660), Peninsula at Bayonne Harbor.
3. WORK SITE: Block 404, Lot 2.10, Block 404.11, Lot 1, Block 1160, Lot 1, Block 1170, Lot 1, and Block 1171, Lot 1, Peninsula at Bayonne Harbor, Bayonne, NJ.
4. WORK DESCRIPTION: Base Bid for project consists of construction of steel bulkhead and a concrete access bridge with an alternate bid for an additional concrete access bridge, and alternates for additional steel bulkhead installation.

6. CONTRACT DOCUMENTS:
Contract Documents may be examined, and/or purchased at $150.00 per set, Monday through Friday, except legal holidays, from 8:00 A.M. to 5:00 P.M., prevailing time, at 611 Industrial Way West, Eatontown, NJ, 07724. Cash is accepted and all checks are to be made out to Birdsall Engineering, Inc. No refunds will be made.
7. USE OF CONTRACT DOCUMENTS:
Contract Documents are available solely for the purpose of obtaining Bids and not to confer a license or grant for any other purpose.

9. BID GUARANTEE:
Bid Guarantee is required in an amount not less than five percent (5%) of the total amount indicated in the Bid.

10. CONSENT OF SURETY:
A certificate is required from a surety company stating that it will provide bonds in the form and amounts as stated in the Contract Documents.
11. SUBMISSION OF BIDS:
Bids shall be placed in sealed envelopes and must be received by Owner on the Date and Time indicated for Public Bid Openings and Reading in Paragraph #12. No bids will be accepted prior to the Bid Opening. Bids must be presented at 11:00 A.M. on the scheduled date, not before. No Bids will be received after the indicated Date and Time. Bidders must hand deliver Bids to Owner at the Place indicated for Public Bid Opening and Reading in Paragraph #12.

13. STATUTORY REQUIREMENTS:
Bidders are required to comply with all applicable Laws and Regulations including the N.J.S.A. 10:5-31 et seq., and N.J.A.C. 17:27 (Affirmative Action) P.L. 1999, C.238 (Public Works Contractor Registration), P.L. 1963, C. 150 (Prevailing Wages) and P.L. 2004, C. 57 (New Jersey Business Registration Requirements).
14. DISCLOSURE OF FEDERAL PARTICIPATION:
Any contract or contracts awarded under the Advertisement for Bids will be funded in part by a grant from the U.S. Department of Commerce – Economic Development Administration (EDA). The total amount of federal funding included in the project financing will be $7,600,000, which represents a portion of the total project costs to include design, construction, project inspection and management of the project. Neither the United States nor any of its departments, agencies, or employees is or will be a party to this advertisement or any resulting contract.
15. REJECTION OF BIDS:
Owner reserves the right to reject any or all Bids and to waive any immaterial defect or informality in any Bid, if deemed in the best interest of Owner.
