a. Resolutions

Resolution #091709-01 Ratifying and affirming various rights of entry/license agreements, as follows:

1) Refused TV, 1656 Sargent Place, Los Angeles, California, for the purpose of shooting a music video in Building 43 on August 14, 2009, for the amount of $4,000.00.

2) Rodolfo Paulino, 8518 Third Avenue, 1st Floor, North Bergen, New Jersey, for one parking space in a designated area of Pad 63 for the period September 1, 2009, through September 30, 2009, for the amount of $231.00 per month.

Resolution #091709-02 Authorizing the execution of an access agreement allowing IMTT-Bayonne to continue certain remediation activities on the property known as the Standard Tank Redevelopment Area, comprised of Block 359, Lot 2, and Block 475, Lots 2 and 3.

Resolution #091709-03 Ratifying and affirming a lease with Paul S. Werther, Esq., for the rental of office space with parking in Building 51 for the period of July 1, 2009, through September 30, 2009, for the amount of $829.73 per month.

Resolution #091709-04 Authorizing an agreement with Flanagan’s Contracting Group, Inc., 90 Old Camplain Road, Hillsborough, New Jersey 08844, for the Bridge and Bulkhead Construction Project at Berths S1, E1 and E2 for the bid amount of $5,970,083.00.

Resolution #091709-05 Awarding a one-year professional general engineering services agreement to LGA Engineering, Inc., from October 1, 2009, through September 30, 2010, for an amount not to exceed $1,350,000.00.

Resolution #091709-06 Awarding a one-year professional services agreement to Excel Environmental Resources, Inc., for environmental engineering services from October 1, 2009, through September 30, 2010, for an amount not to exceed $165,000.00.

Resolution #091709-07 Authorizing a one-year professional legal services agreement with McManimon & Scotland, LLC, to serve as Bond Counsel and Special Legal Counsel in matters relating to environmental law from October 1, 2009, through September 30, 2010, for an amount not to exceed $250,000.00 and allowing for an additional amount not to exceed $250,000.00 to be paid from third-party developer escrows or from bonds issued as non-recourse to the BLRA or the City of Bayonne.

Resolution #091709-08 Awarding a one-year professional legal services agreement to Krivit & Krivit, P.C., to serve as Special Counsel to the BLRA for Federal and State Grants Funding from October 1, 2009, through September 30, 2010, for an amount not to exceed $86,500.00.

Resolution #091709-09 Authorizing a one-year professional services agreement with Suplee, Clooney & Company to provide auditing services from October 1, 2009, through September 30, 2010, for an amount not to exceed $27,100.00.

Resolution #091709-10 Authorizing a one-year professional services agreement with Clarke Caton Hintz to provide planning and architectural services from October 1, 2009, through September 30, 2010, for an amount not to exceed $150,000.00.

Resolution #091709-11 Authorizing a one-year professional services agreement with Jacobs Engineering Group, Inc., for professional engineering and planning services from October 1, 2009, through September 30, 2010, for an amount not to exceed $100,000.00.

Resolution #091709-12 Authorizing/ratifying payment of the bills and expenses from August 8, 2009, through September 11, 2009, totaling $2,273,820.82.

Resolution #091709-13 Authorizing a closed session to discuss pending litigation and negotiations with the U.S. Army.
